Comparative Fault and the Statute of Limitations:

There are a few more things you should know about personal injury claims in California.

The statute of limitations in California is 2 years from the date of the injury. In Government claims, you must file your claim no later than 6 months from the date of injury.

After those periods have passed, you cannot file a personal injury claim in California.

California also follows a comparative fault system. That means that more than one person or party can be considered at fault for your injuries, including you.

For instance, in premises liability cases you may be considered partially liable for your injury if you should have known that there was a risk, like wet floors on the premises.

In those kinds of circumstances, the other party would be responsible only for their percent of liability. If you are deemed 20% liable for your injury and the other party is 80% liable, they would pay 80% of the value of your personal injury claim.
